Carl Formicola Obtains Defense Verdict In Richmond County

Carl Formicola recently obtained a defense verdict in a medical malpractice case in Richmond County. The defendant was a hand surgeon who performed a carpal tunnel release on a 43 year-old woman.

Following the procedure she complained of pain and weakness of her right thumb. She also suffered sensory loss and an inability to abduct the thumb.

She eventually sought treatment from another hand surgeon who performed an exploratory procedure. He determined that the patient had sustained a laceration of the median nerve in the earlier surgery. His videotaped deposition to this effect was played to the jury.

The defendant had testified at his own deposition that a laceration of the median nerve during a carpal tunnel release is a departure from good and accepted practice.

Following approximately two hours of deliberations the jury returned a verdict in the defendant’s favor.
