Associate Annemarie Jones Published in Suffolk Lawyer

We are proud of attorney Annemarie Jones for recently being published in the April 2017 edition of the Suffolk Lawyer.  Her article, entitled “The High Standard for Municipal Liability in a Federal Civil-Rights Action” discusses the standard of liability against a municipality in an action brought pursuant to Title 42, Section 1983. The article addresses that unlike in a state court negligence action, a municipality cannot be held liable under Section 1983 on the basis of respondeat superior simply because it employs an alleged tortfeasor. A municipality’s liability is based on direct causation rather than respondeat superior. Under the United States Supreme Court’s decision in Monell v. Department of Social Services, 436 U.S. 658 (1978), in order to prevail on liability against a municipality under Section 1983, a plaintiff must prove a municipal “policy” or “custom” caused the deprivation of her constitutional rights.
