Dylan Braverman and Thomas Rhatigan Prevail on Summary Judgment With an Assist from Laura Raheb

Dylan Braverman and Thomas Rhatigan succeeded in obtaining summary judgment on behalf of their client, a national security company. Plaintiff brought an action against the property owner, management company and developer of a large, mixed-use luxury property in Queens, New York.  Plaintiff allegedly tripped on a defective and poorly maintained parking lot, while serving as a security guard for the company. As a result, plaintiff alleged multiple surgeries, including a spinal fusion. The plaintiff also alleged an inability to return to work. The Security Company was brought in as a third party on contractual and common law claims.  Dylan and Tom argued that this matter does not fall under any of the exceptions to Worker’s Compensation law barring claims against employers. Further, it was argued, among other things, that the contract did not require the Security Company to provide contractual indemnity or defense to any of the parties.
