Defendant’s Verdict for Michael T. Colavecchio in Neurological Malpractice Case

Between November 20 and December 13, 2017, Lewis Johs Partner Mike Colavecchio successfully defended his client, a neurologist, in a medical malpractice case in the Nassau County Supreme Court.

The plaintiff contended that the doctor failed to timely diagnose an intramedullary cyst as the cause of multiple signs and symptoms in the then 49 year old plaintiff.  Although the client eventually referred the patient to a neurosurgeon to perform the surgery, the plaintiff contended that the patient should have been immediately referred after the first visit, and the failure to do so resulted in irreversible spinal cord damage.  Plaintiff currently has a dropped foot, which she attributes to the alleged delay in referral to a surgeon.

The jury returned a verdict in favor of the client on December 13, finding that the doctor did not deviate from the standard of care, and that the treatment, and workup for other potential causes of the signs and symptoms, was medically appropriate.
