Teri Scotto-Lavino Obtained Summary Judgment in Medical Malpractice Action

Teri Scotto-Lavino was successful in obtaining dismissal of an action asserted against a provider of alternative medicine. Plaintiff alleged that as a result of the treatment he suffered significant injury. Plaintiff also alleged that the use of the alternative medicine was illegal in the United States and that the provider should be prevented from practicing.
Ms. Scotto-Lavino successfully argued that the provider was an expert in the field and that plaintiff, moving for summary judgment on his own behalf, needed an expert to raise a triable issue of fact. Further, the Court agreed that plaintiff was unable to support that he suffered any of the claimed damages and dismissed this matter summarily without the need for a trial.
