Rosa M Feeney won a permanent stay of arbitration in a Supplementary Uninsured Motorist case, where the claimant sought uninsured benefits under his business auto policy for injuries sustained when he was in a rental vehicle in Florida, which he rented for business and pleasure. Rosa argued that at the time of the accident the claimant was on his way to dinner for pleasure and that he could not recover under the commercial business auto policy for personal use of a rental vehicle. The court agreed and permanently stayed the demanded arbitration.
