Teri Scotto-Lavino Obtained Summary Dismissal of a Medical Malpractice Action

Teri Scotto-Lavino obtained dismissal of a medical malpractice action on behalf of a medical professional corporation at which many of the named defendants maintained offices. Plaintiff alleged that, as multiple named defendants maintained offices in the building, the medical corporation should be held liable for the actions of the individual doctors. The Court agreed that the individual doctors were not employees of the professional corporation; thus, the professional corporation could not be held vicariously liable for the acts of the doctors during the time of the treatment rendered to the plaintiff.
