Amy Pincus Obtains Summary Judgment

Amy Pincus was successful in obtaining summary judgment for an insurance carrier in Supreme Court, Kings County in a first-party coverage dispute.  The plaintiff was seeking recovery of several hundred thousand dollars’ worth of damage to a residential rental property allegedly caused by freezing pipes.  Our client, an insurance carrier,  disclaimed coverage due to the landlord/plaintiff’s own lack of maintenance of the property.  The landlord brought suit for breach of contract.  The Court, in granting summary judgment, upheld the disclaimer and found the property had not been properly maintained.
