Partner Annemarie Jones Obtains Summary Judgment Dismissal In Section 1983 Case
Annemarie Jones obtained summary judgment dismissing all claims asserted against the former Deputy Chief of Patrol of the Nassau County Police Department. Briefly, pursuant to 42 U.S.C. § 1983, Plaintiff’s claims of civil rights violations arose from an incident in 2011 in which he alleged an intoxicated off-duty Nassau County Police Officer fired five rounds at him – one round striking him – and then battered Plaintiff. Thereafter, Plaintiff alleged he was falsely arrested and maliciously prosecuted as part of a cover-up and conspiracy involving the Nassau County Police Department and Suffolk County Police Department. The Court held that all claims asserted against the former Deputy Chief of Patrol pertaining to his alleged involvement in a cover-up and conspiracy were speculative and not supported by any admissible evidence.
