Ross Ruggiero Successfully Obtains Favorable Arbitration Award Dismissing Claim

Ross Ruggiero successfully won an arbitration before the American Arbitration Association wherein the applicant was seeking no-fault benefits from his client’s insurance policy. Ross argued that under the no-fault insurance law, liability for the causation of the accident is not a factor in determining who is responsible for paying no-fault benefits. Rather, the no-fault law requires payment from the vehicle which proximately caused the applicant’s injuries. In this case, the co-defendant was the proximate cause of the applicant’s injuries. As such, the arbitrator found in favor of Ross’ client and found that the co-defendant’s insurer was responsible for providing the applicant with no-fault benefits.
