Senior Counsel Joseph A. Materazo Prevails on Pre-Answer Motion to Dismiss

Joseph A. Materazo recently prevailed on a Pre-Answer Motion to Dismiss on behalf of an insurance carrier client in an action venued in Supreme Court, Ulster County. The case involved allegations of nationwide fraudulent business dealings against the carrier in the resale of motor vehicles to the general public through a third-party business entity. Joseph successfully argued that the plaintiff failed to plead causes of action for fraud, fraudulent inducement, concealment, and civil conspiracy with the requisite specificity.  The Court agreed and dismissed the action in its entirety.
