Mark Aledort Prevails on Summary Judgment Motion in Premises Liability Case

Partner Mark Aledort obtained summary judgment on behalf of our client in a Nassau County Supreme Court premises liability case. The matter centered on a hospital employee who claimed she was walking in a hallway when a fire extinguisher, which was mounted to a wall bracket, fell and landed on her foot. Mark represented the fire extinguisher company that performs yearly maintenance. Mark argued that our client did not owe a legal duty to the plaintiff under the Espinal line of cases and that any theory of negligence would have to be based upon improper speculation. The Court agreed and dismissed all claims against our client.
