Summary Judgment and Dismissal of Complaint Obtained by Jason Katz

Principal Jason Katz obtained summary judgment and dismissal of the plaintiff’s complaint and all crossclaims asserted against his client in a Labor Law matter pending in Westchester County Supreme Court. The plaintiff was working at a construction site and specifically standing on a platform pumping concrete when he fell to the ground. Plaintiff cited to alleged violations of Labor Law sections 240(1), 241(6), 200 and common law negligence. Jason successfully argued that his client was not a proper Labor Law 240(1) or 241(6) defendant, that his client did not create any allegedly hazardous condition or supervise or control the activity that resulted in the plaintiff’s fall and that it owed no duty to the plaintiff. The Court agreed and dismissed all claims against his client, with prejudice.
