Ross Ruggeriero Obtains Dismissal of Plaintiff’s Claim

Ross Ruggiero successfully obtained an Order of Dismissal from the Civil Court, Richmond County granting dismissal of the plaintiff’s complaint in favor of the defendant. Plaintiff sued our client, a Third-Party Administrator on behalf of an insurance company, seeking to recoup no-fault benefits under an insurance policy. Ross argued that the court lacked jurisdiction and that plaintiff named an improper party.  He argued that the defendant Third-Party Administrator was not an actual insurer providing no-fault benefits. Ultimately, the Court agreed with the defendant’s argument and summarily dismissed the action in the defendant’s favor.
