Commercial Litigation Partners Jennifer Hurley McGay and Bryan F. Lewis were recently published in The Suffolk Lawyer, Commercial Division Special Edition (June 2019).   Their article, “Primer on Non-Subpoenas in New York State,” discussed the importance of non-party subpoenas in commercial cases.  The article went on to provide an overview of the requirements for a valid subpoena, the relative burdens, and standards if the subpoena is challenged and the benefits of meeting and conferring with non-parties, even though not technically required under the CPLR.
