Adam H. Silverstone was successful in obtaining summary judgment dismissal of a breach of contract and fraud action asserted against our client, a Long Island horse-trainer and equestrian facility operator. The plaintiff alleged that our client, together with co-defendant veterinarians, fraudulently induced the plaintiff into purchasing a horse that was not fit for its intended purpose as a competitive hunter-jumper horse. Adam successfully argued that our client was not an owner and proper party to the sales contract for the horse, did not make any representations as to the fitness of the horse, and provided the plaintiff with an extended opportunity to test the horse prior to its sale as well as the opportunity to obtain a pre-purchase medical examination of the horse with a veterinarian of plaintiff’s choice prior to the transaction.
