Annemarie Jones Obtains Dismissal of Complaint in Southern District of New York

Annemarie Jones was successful on a Federal Rule of Civil Procedure 12(b)(6) motion to dismiss plaintiff’s complaint in the Southern District of New York. Plaintiff alleged that certain supervisory officials of the Sullivan County Jail violated his civil rights pursuant to Section 1983 by not properly responding to his grievances and failing to reverse the outcome of an allegedly unconstitutional disciplinary hearing. In a 59-page decision, the Southern District held Plaintiff did not properly allege their direct personal involvement in any constitutional violation and dismissed all claims asserted against them.
