Mark R. Aledort Obtains Summary Judgment

Mark R. Aledort was successful in obtaining summary judgment for a demolition contractor in Supreme Court, Suffolk County.  The plaintiff fell on a defective sidewalk which had been excavated for the project and the plaintiff claimed someone had removed warning tape around the sidewalk and our client did not provide affidavits from all employees that they did not remove the tape.  However, the Court agreed with Mark’s arguments that the plaintiff relied on speculation and there was no evidence that our client launched an instrument of harm.
