Annemarie Jones Secures Summary Judgment

Annemarie Jones obtained summary judgment dismissing all federal claims in a Section 1983 malicious prosecution case. Plaintiff alleged the District Attorney’s Office maliciously prosecuted him for his alleged practice of fraudulent billing. Plaintiff was acquitted of all criminal charges following a jury trial. He thereafter filed the Section 1983 case against the County and the District Attorney’s Office. The Eastern District of New York dismissed all federal claims finding the Defendants were entitled to the defenses of absolute and qualified immunity.
