Associate Ross Ruggiero Obtains Winning Decision in Supreme Court, Kings County
Attorney Ross Ruggiero successfully argued before the Honorable Francois Rivera in Supreme Court, Kings County that plaintiff’s request to file a late motion for summary judgment should not be considered. Plaintiff filed a Note of Issue on December 4, 2019, and the court required that all motions for summary judgment be filed within 60 days of the filing of the Note of Issue. Plaintiff argued that they accidentally noted their file as a Bronx County case, thereby thinking that they could file their motion 120 days from the filing of the Note of Issue. Plaintiff further argued that when they discovered their error, they were not immediately able to file their motion due to the Covid pandemic. Judge Rivera agreed with Ross’s position that the pandemic played no part in plaintiff’s late filing and denied plaintiff’s motion.
