Partner Amy E. Bedell Obtains Summary Judgment on Behalf of Homeowner

Partner Amy E. Bedell obtained summary dismissal of a case alleging negligence and violations of the Labor Law against a homeowner who engaged a contractor to perform renovations to the pool area of her home. Amy successfully argued that, as the owner and full-time resident of a single-family dwelling who did not direct, control or supervise the work, the defendant could not be held liable for plaintiff’s injuries under the Labor Law. The Court also agreed that the defendant had no knowledge of the dangerous condition that was alleged to exist near where the plaintiff’s ladder was placed, nor did she direct the placement of the ladder. Thus, the Court held that defendant could not be held liable in negligence.
