The Municipal Violation Practice focuses on violations issued to property owners, commercial and residential tenants, as well as major construction companies as it relates to violations issued by New York State, local municipality, and – predominantly – New York City enforcement agencies. We cover all matters including, but not limited to, those issued by the Department of Buildings, Fire Department (FDNY or other locality), Department of Health, Department of Transportation, and the Department of Environmental Protection, ranging from minor issues such as obstruction of means of egress to violations that involve serious construction-related accidents and failure to safeguard.
Lewis Johs’s attorneys work in close conjunction with the client, meeting on site where appropriate, to prepare a defense or, if applicable, to assist with the cure and correction submission to the respective department. We then represent the client at the resulting hearings before the Environmental Control Board/Office of Administrative Trials and Hearings (“OATH”) as well as the New York City Criminal Court or those in other jurisdictions. Where necessary and warranted, we then handle the ensuing appeals (either initiated on behalf of the client or opposing the appeal of the issuing agency).
